How Interocean collects, uses and protects personal data, and the rights you have over it.

1. Who we are

Interocean Marine Services Limited (“Interocean”, “we”, “us”, “our”) is the controller of the personal data described in this notice for the purposes of the UK General Data Protection Regulation and the Data Protection Act 2018. We are registered in Scotland under company number SC330887. Our registered office is 2 Marischal Square, Broad Street, Aberdeen AB10 1DQ, and our group headquarters is 227 Ingram Street, Glasgow G1 1DA.

This notice applies to visitors to our website, to people who contact us by telephone, email, the enquiry form or other means, and to people we deal with in the course of our business, including at our clients, suppliers and partners.

3. Our commitment

We are committed to protecting your personal data and your privacy. This notice sets out the basis on which any personal data we collect from you, that you provide to us, or that we acquire from a third party will be processed by us. Please read it carefully to understand our practices regarding your personal data and how we will treat it.

Before we process your personal data, we are obliged to tell you who we are, why we need to process it, what we will do with it and to whom we will pass it. It is important that the personal data we hold about you is accurate and current, so please keep us informed if your details change during your relationship with us.

4. The data we collect about you

Personal data means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). We may collect, use, store and transfer the following kinds of personal data about you.

4.1Identity data: first name, last name, title and job title.

4.2Contact data: business address, email address and telephone numbers, and the company or organisation you represent.

4.3Enquiry data: the content of enquiries you send us through the website form, by email or by telephone, including the location or service the enquiry concerns.

4.4Technical data: internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the website.

4.5Usage data: information about how you use our website, collected in aggregate through analytics cookies where you have consented to them.

4.6Marketing and communications data: your preferences in receiving marketing from us, and your communication preferences.

4.7Recruitment data: information you provide when applying for a role with us through our recruitment platform, including your CV, employment history and qualifications.

5. Special categories of personal data

We do not seek special categories of personal data through this website. Special categories include details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, health, and genetic and biometric data. If you apply to work with us, any such information requested during the application process is used only for the purposes of equal opportunities monitoring, as stated in that process, and with your explicit consent.

6. How your personal data is collected

We use different methods to collect data from and about you.

6.1Direct interactions. You may give us your personal data by filling in the enquiry form on our website, by corresponding with us by post, telephone or email, by requesting information from us, or by applying for a role with us.

6.2Automated technologies. As you interact with our website we may collect technical data about your equipment, browsing actions and patterns. We collect this data using cookies and similar technologies, as described in our Cookie Policy, and only set analytics cookies with your consent.

6.3Third parties and publicly available sources. In the course of our business we may receive identity and contact data about you from your employer or organisation, from our clients and partners, and from publicly available sources such as Companies House and professional networks.

7. How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; where it is necessary to perform a contract with you or to take steps at your request before entering into one; or where we need to comply with a legal or regulatory obligation.

Generally we do not rely on consent as a legal basis for processing your personal data. We will ask for your consent before sending you direct marketing by email, and before setting analytics cookies on your device. You can withdraw that consent at any time.

9. Disclosures of your personal data

We may share your personal data with the parties set out below for the purposes described in this notice. We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our service providers to use your personal data for their own purposes and only permit them to process it for specified purposes and in accordance with our instructions.

9.1Members of our group, meaning our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the Companies Act 2006, where an enquiry or relationship is handled by another group company.

9.2Service providers who host our website and its infrastructure, provide our email and business systems, and operate our customer relationship management system, in which enquiries are recorded and managed.

9.3Providers of analytics and map services used on our website, as described in our Cookie Policy.

9.4Our recruitment platform provider, where you apply for a role with us.

9.5Professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.

9.6Regulators, authorities and other bodies where we are required to do so by law, or to protect our rights, property or safety or those of our staff, clients or others.

9.7Third parties to whom we may sell, transfer or merge parts of our business or our assets, who will be required to use your personal data in the same way as set out in this notice.

10. International transfers

We operate in many countries, and some of our service providers are based outside the United Kingdom, including in the United States. Whenever we transfer your personal data out of the UK we ensure a similar degree of protection is afforded to it by relying on one of the following: a transfer to a country that the UK has found to provide an adequate level of protection for personal data; the UK International Data Transfer Agreement or the UK Addendum to the EU standard contractual clauses; or, for transfers to the United States, a recipient certified under the UK Extension to the EU-US Data Privacy Framework.

11. Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have procedures in place to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

12. How long we keep your data

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting or reporting requirements.

To determine the appropriate retention period, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure, the purposes for which we process it and whether we can achieve those purposes through other means, and the applicable legal requirements. Enquiries that do not lead to a business relationship are kept only for as long as needed to respond and follow up; records relating to a contract are kept for the life of that relationship and for the period afterwards that the law requires. Unsuccessful recruitment applications are kept for a limited period after the role is filled, in case a similar role arises, and then deleted.

13. Marketing

We will only use your personal data for direct marketing by email where you have consented to it, for example by ticking the opt-in on our enquiry form. We do not share your personal details with any third party for their own marketing purposes. You have the right to withdraw your consent to marketing at any time by following the unsubscribe link in any message we send you, or by contacting us using the details above.

14. Cookies

Our website sets essential cookies needed for it to work, and analytics cookies only if you accept them in the cookie notice. You can change your choice at any time. You can also set your browser to refuse all or some cookies, or to alert you when websites set or access cookies; if you disable or refuse cookies, some parts of the website may not function properly. 15. Your rights

Under data protection law you have rights in relation to your personal data. These are the rights to:

15.1Request access to your personal data (a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

15.2Request correction of the personal data we hold about you. This enables you to have any incomplete or inaccurate data corrected, though we may need to verify the accuracy of the new data you provide.

15.3Request erasure of your personal data where there is no good reason for us continuing to process it, where you have successfully objected to processing, where we may have processed it unlawfully, or where we are required to erase it to comply with local law. We may not always be able to comply for specific legal reasons, which will be notified to you at the time of your request.

15.4Object to processing of your personal data where we are relying on a legitimate interest and there is something about your particular situation which makes you want to object on this ground. You also have the right to object where we are processing your personal data for direct marketing.

15.5Request restriction of processing of your personal data, for example while we establish its accuracy or our grounds for using it.

15.6Request the transfer of your personal data to you or to a third party, in a structured, commonly used, machine-readable format. This applies to automated information you initially provided consent for us to use or that we used to perform a contract with you.

15.7Withdraw consent at any time where we are relying on consent to process your personal data. This will not affect the lawfulness of any processing carried out before you withdraw it.

16. Exercising your rights

If you want to exercise any of these rights, please contact us using the details above. You will not have to pay a fee to access your personal data or to exercise any of your other rights. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive, or refuse to comply with it in those circumstances. We may need to request specific information from you to help us confirm your identity, and we try to respond to all legitimate requests within one month.

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason that is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and explain the legal basis which allows us to do so.

You also have the right to complain at any time to the Information Commissioner’s Office (ICO), the UK regulator for data protection issues (ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO, so please contact us in the first instance.

17. Changes to this notice

We may update this notice from time to time. The date at the top shows when it was last revised. Where a change materially affects how we use your personal data, we will take reasonable steps to bring it to your attention.
